Financial Penalties for Certain Breaches

Local authorities have powers to impose financial penalties for certain breaches of housing legislation, including licensing failures and other specific offences.

Depending on the nature and seriousness of the breach, penalties can be substantial.

Some offenses now carry maximum civil penalties of £40,000! While certain breaches carry a maximum of £7,000 per offence. The applicable amount depends on the legislation and circumstances.

Understanding the New Possesion Rules

Under the Renters' Rights Act 2025, landlords can no longer use Section 21 to begin a no fault possession claim.

Landlords seeking possession generally need to rely on a valid legal ground, follow the correct notice procedure and, where necessary, obtain a court order.

Existing proceedings started under the previous rules may still continue under transitional arrangements.

Rent Repayment Orders (RROs): Potential Financial Consequences.

For certain housing offences, tenants or local authorities may apply to the first tier Tribunal for a Rent Repayment Order.

Where an order is made, landlords may be required to repay rent, with the amount depending on the offence and circumstances.

For relevant offences, committed from the 01st May 2026, the maximum period increased to 24 months rent. Earlier offences subject to different rules.
